3. ADL’s Role and Limitation as a Facilitator

ADL’s operational remit is strictly that of a technological facilitator, marketplace host, and connecting agent. We furnish the infrastructure enabling Members to engage with one another.

• Non-Employment Relationship: ADL does not directly employ, contract with, or manage the Providers listed on the platform. The relationship between a Receiver and a Provider is solely between those two parties, and ADL disclaims responsibility for the terms, performance, or termination of any resulting arrangement.
• Vetting of Content and Conduct: While ADL may enforce general community standards, we do not undertake to vet, monitor, edit, approve, or scrutinise every specific interaction, message, document, profile, or piece of content (collectively, "Your Content") uploaded, shared, or exchanged by individual Members.
• Liability for Member Actions: ADL assumes absolutely no liability for the conduct, actions, representations, or omissions of any Member, including any misrepresentation by a Provider concerning their qualifications or any misuse of "Your Content" (including confidential information or intellectual property) by any other Member or third party.

4. Risks Associated with Technology and External Third Parties

ADL operates within a complex technological ecosystem. Notwithstanding reasonable efforts to maintain security, ADL shall not be liable for any direct or consequential loss, damage, or detriment suffered by the user, howsoever arising, as a result of:

• Malware and Security Threats: The presence, distribution, or transmission of computer viruses, malicious software (malware), Trojan horses, or other destructive or harmful components that may infect the user's equipment or data, whether originating from the Website or linked third-party sources.

6. Preservation of Mandatory Consumer Rights

This Extended General Disclaimer is drafted with the intention of limiting liability only to the maximum extent permissible by law. Nothing in this disclaimer is intended to limit, restrict, or exclude any guarantees, warranties, or rights implied by law, including those provided under the Australian Consumer Law (ACL), which cannot be legally excluded.

To the extent that any Services supplied by ADL are subject to a statutory consumer guarantee that cannot be excluded, and ADL fails to comply with that guarantee, our liability shall be strictly limited, at our discretion, to:

• (b) Assumption of Risk: It remains your exclusive responsibility to verify the identity, legitimacy, and professional credentials of any Provider or advertiser prior to applying for a position, sharing personal information, or entering into any external contractual agreement.
• (c) Exclusion of Liability for Harm: To the maximum extent permitted by law, Advanced Dev Logics and its parent companies, affiliated entities, directors, and employees shall not be liable for any harm, loss, or damage (including financial detriment, identity theft, or personal injury) resulting from:
  • Your interactions with other Members;
  • Your reliance upon the accuracy or legitimacy of any job advertisement or third-party content; or
  • The conduct, whether lawful or unlawful, of any third party or Member.
• (d) Reporting Mechanism: Should you encounter a listing or Member that you suspect is fraudulent or potentially harmful, you agree to notify us without delay at support@careerjobs.com.au to enable us to determine the necessity of removing that Member from the Services.

8. Confirmation of Liability Limits

In accordance with the existing terms:

• Total Liability Cap: Advanced Dev Logics’ aggregate liability for any claim arising from the Services is capped at the cost of resupplying the Services to you.
• Exclusion of Damages: We expressly disclaim liability for any direct, indirect, or consequential damages, including loss of profit or reputation, arising from your utilisation of the Website.
